Travel Agreement

By registering and signing up for any group trip planned and/or sponsored by DC Explorers LLC authorized to do business as Enlighten Excursions (hereinafter “ENLIGHTEN”), the participant agrees to the following terms and conditions:

ENLIGHTEN and or their agents act only in the manner of providing services and cannot accept responsibility in whole or part for the following:

ENLIGHTEN shall be responsible to the passenger for supplying services and accommodations described in this “online” group trip brochure, except where such services cannot be supplied or the itinerary used is changed due to delays or other causes of whatever kind or nature beyond the control of ENLIGHTEN, their operators or agents. In such circumstances the operators will do their best to supply similar or comparable services, accommodations, and itineraries and there shall be no refund under this condition.

In the absence of their own negligence, neither the operators nor their agents, or co-operating organizations shall be responsible for any cancellations or for any acts of any other service provider, diversions or substitution of equipment, of any act variations, postponements, omission or default whatsoever by any air carriers, land carriers, hoteliers, hotels, transportation companies, or any other persons providing services and accommodations to passengers including any results thereof, such as changes in services, accommodations, or facilities necessitated by the same.

Nor shall ENLIGHTEN be liable for any loss or damage to baggage or property or for injuries, illness, or death or for any damages or claims whatsoever arising from loss, negligence, or delay from the act, error, omission, default or negligence of any country, government, governmental authority, officer or employee. All baggage and personal effects are at all times and in all circumstances at the risk of the tour participant. Upon return to the United States, if ENLIGHTEN finds and returns lost articles to the owner, a minimum service fee of $100 will be charged. The carriers, hotels, and other suppliers who provide services on tour are independent contractors; they are not agents, employees, or servants of the operators or their associated companies. The operators are not responsible for any criminal conduct by third parties.

Where the passenger occupies a motor coach seat fitted with a safety belt, neither the Operators nor their agents or cooperating organizations or service providers concerned will be liable for any injury, illness, or death or for any loss or damages, or claims whatsoever arising from any accident or incident if the safety belt is not being worn at the time of such accident or incident.

Transportation companies, airlines, etc. are not to be held responsible for any act, omission, or event during the time passengers are not on board planes, transportation, or conveyances. The passenger contracts in use by the airlines or transportation companies when used shall constitute the sole contract between the airline, transportation company and passenger or purchaser of this tour, and the Operators assume no responsibility in this connection. Enrollment in and payment for a tour shall constitute agreement and acceptance by the passenger of the terms and conditions set forth in this “online” group trip brochure which cannot be varied except in writing by an officer of the company.

Changes/Cancellations: Changes may not be possible after initial deposit is made. Changes that are made by a traveler after the initial deposit affecting destination, departure date, passport names and/or traveler names are subject to a processing fee of $75 in addition to any cost incurred from our suppliers. Once the tour has departed, changes affecting return date or gateway will not be permitted. All trip cancellations will incur a $150 agency cancellation fee in addition to any cancellation penalties charged by the service providers.

It is the responsibility of the participant to comply with the terms, conditions, or requirements of any service provider, or any country or governmental authority, or to bear any costs or losses incurred as a consequence of that participant not complying with them.

It is the passenger’s responsibility to know of any government restrictions to their travel such as inclusion on the no fly lists or other restrictions based on past convictions for DUI or sex offender charges that may prohibit them from travel.

ENLIGHTEN reserves the right to increase published trip, cruise rates and air fare supplements without prior notice when necessary because of vendor increases.

ENLIGHTEN reserves the right to modify or cancel travel trips due to vendor, outfitter or supplier changes or cancellations, or weather conditions out of our control.

It is the passenger’s responsibility to have appropriate documents for identification, to read and understand the cruise line’s or tour company’s cancellation policies and penalties and to be informed of any state department warnings relevant to their destinations. Passengers must also be aware of any health risks and take the appropriate precautions.

Customers must reconfirm domestic flights and seat selections 24 hours in advance.

Reconfirm international flights and seat selections 72 hours in advance.

Hotel and car reservations should also be reconfirmed.

Please check in for domestic flights 1 ½ hours in advance.

Please check in for international flights 3 hours in advance (2 hours for European flights).

AIRLINES: Enlighten Excursions CANNOT guarantee that airlines will not change or alter the client’s itinerary. It is HIGHLY recommended the passenger go at least a day or more prior to their scheduled cruise or tour and plan to stay a day or two after in case airline schedules change. If the passenger books their own air, it is the passenger’s responsibility to arrive on time for the planned travel date. There are no refunds from the airlines to compensate for itinerary changes.

It is the passenger’s responsibility to have appropriate documents for identification, to read and understand the cruise line’s or tour company’s cancellation policies and penalties and to be informed of any state department warnings relevant to their destinations. Federal law prohibits carriage of certain hazardous materials aboard aircrafts in your luggage or your person and could result in a fine. Visit TSA and click on “prohibited items” for more information.

Prior Criminal Convictions: Mexican law permits immigration authorities to deny foreigners entry into Mexico if they have been charged or convicted of a serious crime in Mexico or elsewhere.

REFUNDS: If Enlighten Excursions makes payments to suppliers on behalf of customers, refunds, IF DUE from airlines, tour companies, cruise lines or hotels will be paid to our customers only after any penalties and fees have been deducted or paid and after Enlighten Excursions has received the refund from the relevant provider.
